FACT: I can now confirm that there was NOT unanimous agreement and support on the content or publishing of the recent Beaver Island Airport Commission letter. In fact there may not have been any agreement or support by anyone other than the author.

I have promised to retract or clarify anything I post to this Forum if not factual. Yesterday, I received an e-mail from Mr. Steve West accusing me of being a dangerous liar preceded by profanity. I am not going to post my response and factual clarification to him on the Forum because of the profanity and defamatory language he used in his e-mail when attacking my character.
Ordinarily this would have been a private e-mail except by fact Mr. West sent it to other recipients including the Charlevoix County Sheriff, thus it is now public information.
I responded to all recipients stating I would not go public with Mr. West's e-mail for 48 hours, allowing time for each party to confer with legal counsel.
Because Mr. West's e-mail is now public, anyone can request a copy from Mr. West directly or by contacting the Sheriff's Office (which may or may not release it).
I will make the complete e-mail and reply available to anyone who contacts me at: k.d.mcbride@att.net after 5 pm Thursday at the end of the 48 hour grace period.

I've been asked if I will reveal the names of individuals I e-mail Steve's e-mail and my response to, the answer is NO, those will remain confidential. I just need to wait until after 5pm today.

All we ask for is the facts. I look forward to hearing more quotes from the trial. I hear there may be a Top 10 of "He said WHAT under oath? coming out soon.

Bwahahahahaha!!!!!!! Don't hurt our little buddies feelings now Jim! Heck, I was thinking Galen might want to consider putting his hat in the ring for the Airport Committee. His campaign to the people for nomination could be:

"Hey, I have no idea what the job is but at least I never cost the tax payers three quarters of a million dollars"

That would be a good campaign slogan for anyone running for the BIAC. I've talked with Galen about all these issues we are facing. Trust me, Galen is on the right side of our Island's government issues.

Have you ever slowed down to stare at the twisted metal of an accident on the side of the road? Sometimes people go around the block to get another look at it. Most aren't really interested in what caused the accident or even who's at fault. It's just human nature to slow down and look. I hope noone misinterprets the number of views here as interest in the subject. It could be suggested that most are just going around the block to see the twisted wreck again.

Soon the wrecker will haul off those involved and the glass will be swept up. The curious bystander will move on until the next wreck...and then...sure as the sun will rise tomorrow, those who point fingers appear again.

Well it would be nice if we could just stop having the wrecks. I am sure we all learned a little something from this. (I hope). I also want ALL to know that I believe that EVERYONE involved are good people who had nothing but good intentions. But I do hope in the future we can slow down, and just think things through a bit better.

Has a settlement been reached in the court case? Will there be an appeal? I understand the total cost thus far for the settlement has exceeded $1,000,000 and still counting.

I posted a comment on the Petoskey News website that I believe was shared in this Forum. My comment was unfairly critical of township and Airport officials, but I did not have all of the facts and the background on the land acquistion history. As a lawyer, I am trained to gather all the facts before taking action, and I did not do that with my comment which was more an angry reaction to the $1Million judgment in favor of the Albins. I now know more of the history of this transaction. My comment and opinion I expressed offended many people including some of my friends. I regret this and I sincerely apologize. Our township and various committee officials work hard and tirelessly to improve life for all of us on Beaver Island. I applaud and appreciate their efforts. My first comment in this Forum will likely be my last.

Please note my post, December 05, 2011, 9:36am (above on this thread). I made a statement that the Beaver Island Airport Commission letter printed in the NorthernIslander was in fact an indication of a violation of the Open Meetings Act. The decision stated in the letter was not obtained at a public open meeting which is in fact the violation.

Steve West responded to my post with an e-mail to the owners of the BI Forum, Charlevoix County Sheriff and me stating that I was a "g...d... liar, dangerous person and needed to be stopped".

I stated that if my facts of the violation allegations were not correct, I would print a retration. It was just recently confirmed by the Charlevoix County Prosecutor that a violation of the Open Meetings Act did occur as evidenced in the NorthernIslander letter. I therefore stand by my facts as stated, no retraction by me necessary.

Given Steve West's legally libel remarks were proven wrong, I would ask that he make a public apology and retraction, on this Forum, of his personally damaging accusations toward me.

I've received e-mail asking if I have the documentation of the OMA/FOIA violations or how the documents can be obtained. I do have a copy of the 15 page documentation, a 7 page and 8 page letter, from the Prosecuting Attorney's Office. These documents are available on the Island from the Beaver Island Airport Commission board members right now and they will be presented at the two March township meetings, St. James March 7th and Peaine March 14th, should be available at both meetings.
These letters are addressed to the BIAC Board Members but available to the public through the Freedom Of Information Act.
