I think the mean spirited crows stop going to the meeting and joined the forum instead. Although it seems they are having a hard time finding something to complain about that carries any water, I am confident they will keep looking.

Meeting called to order at 7:01pm.
MOTION Kohls, second Kubic to approve the minutes of the April 11th, 2018 regular meeting, motion approved.

Resolution #10-2018 Offered by Kohls, supported by Kubic to amend the Zoning Ordinance to change the designation of the approximately 24 acre Parcel on East Side Drive from R2 to Agricultural Property ID: 15-012-015-008-10 Roll Call Vote: Yes: Welke, Kubic, Kohls, C. Martin, E. Martin No: None Absent: None Resolution Adopted.

MOTION Kohls, second Kubic to engage the environmental engineers Gosling Czubak for an estimated $2400 Phase 1 Environmental Assessment on the properties that will be leased from the DNR, motion approved.

MOTION Kohls, second Kubic to accept the bid from Jean’s Lawn Service for the 2018 lawn care season, motion approved.

MOTION Welke, second E. Martin to recommend to the Beaver Island Rural Health Center that they add a Beaver Island Emergency Services Authority board member to their board, motion approved.

MOTION Kohls, second C. Martin to appoint Donna Kubic to the Beaver Island Emergency Services Authority for a 3-yr term, motion approved.

The list of individuals authorized to use a Township credit card was read. The list includes the Supervisor, Treasurer, Clerk, Transfer Station Manager, Airport Manager, Head of Maintenance, and Parks/Recreation/Handyman.

MOTION Kohls, second E. Martin to adopt the credit card policy/signature page with a limit of $500 per purchase unless preauthorized for Transfer Station Manager, Airport Manager, Head of Maintenance, and Parks/Recreation/Handyman, motion approved.

Resolution #11-2018 Offered by Kohls, supported by Kubic WHEREAS, the adoption of guidelines for poverty exemption is within the purview of the township board; and
WHEREAS, the homestead of persons who, in the judgment of the supervisor and board of review, by reason of poverty, are unable to contribute to the public charges is eligible for exemption, in whole or in part, from taxation under Public Act 390 of 1994 (MCL 211.7u); and
WHEREAS, pursuant to PA 390 of 1994, Peaine Township, Charlevoix County adopts the following guidelines for the supervisor and board of review to implement. The guidelines shall include but not be limited to the specific income and asset levels of the claimant and all persons residing in the household (income of students under the age of 18 years shall not be included), including any property tax credit returns, filed in the current or immediately preceding year;
To be eligible, a person shall do all of the following on an annual basis:
1. Own and occupy as your principal residence, as defined in Section 7dd of the General Property Tax Act, the property for which the exemption is requested. 2. File a claim with the supervisor or board of review, on an application provided by the township assessor. If you did not file a tax return then you must get a statement of benefits paid from the Social Security Administration or Michigan Department of Social Services. All applicants must submit most recent copies of the following:
A. Federal Income Tax Return (1040 or 1040A) B. State of Michigan Income Tax Return C. Homestead Property Tax Claim (MI-1040CR) D. All statements of income (ex: W-2’s, 1099’s, etc)
NOTE: Applicants may be reviewed by the Board of Review without applicant being present. However, the Board of Review may request that any or all applicants be physically present to respond to any questions they may have. This means that you could be called to appear on short notice. You may have to answer questions regarding your financial affairs, health status and status of people living in your home, etc. before the board of review. Teleconferencing for the purpose of asking questions of the applicant is allowable if the applicant is not able to attend.

3. Produce a valid driver’s license or other form of identification if requested 4. Produce a deed, land contract, or other evidence of ownership of the property for which an exemption is being requested. 5. Have an income less than or equal to the federal poverty income standards as defined and determined annually by the United States Department of Health and Human Services and published by the State Tax Commission in their Procedural Changes Bulletin. The most recently published data is as follows: 6. The application for an exemption shall be filed after January 1, but before the day prior to the last day of the board of review. The board of review meets three times per year, each March, July and December. NOTE: Sign the application at the office of the assessor or supervisor when the application is returned. If the applicant cannot personally return the application, a notarized application is acceptable.
7. Additional eligibility requirements as determined by the township board; a. The board of review shall follow the policy and guidelines established herein when granting or denying an exemption. b. The board of review may deviate from the guidelines if it determines there are substantial and compelling reasons which are to be communicated, in writing, to the applicant. Compelling reasons include, but are not limited to, excessive medical expenses or excessive expenses necessary for the care of elderly or handicapped persons, etc. c. Applicants may be subject to investigation of their entire financial and property records by the Township. This would be done to verify information given or statements made to the board of review or assessor in regard to the poverty tax claim. d. All applicants will be evaluated based on data and statements given to the Board by the applicant. The Board can also use information gathered from any other source. e. The True Cash Value of property for which the poverty exemption is requested shall be a consideration by the board of review when determining hardship. f. Asset Eligibility: The value of property in excess of what is considered part of the original homestead shall be considered an asset. Assets include, but are not limited to: real estate other than the principal residence, motor vehicles, recreational vehicles and equipment, certificates of deposits, savings accounts, checking accounts, cash, stocks, bonds, life insurance, coin collections, boats, jewelry, retirement funds, etc. Assets (except the original homestead, essential household goods and the first $5,000 of the market value of a motor vehicle), shall not exceed $ 50,000 for an individual applicant and/or $ 15,000 per household if more than one contributor. g. The board of review will consider all assets of the owner, co-owner(s) and all qualifying financial members of the household. Any attempt to hide and/or shift assets to another person, business or corporation shall be grounds for denial. Handicapped or infirmed applicants may call the Clerk’s office to make necessary arrangements for assistance.
If the applicant fails to supply the required documents and/or fails to complete the application in its entirety, or if the information supplied is found to be fraudulent, the application shall be denied.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the board of review shall follow the above stated policy and federal guidelines in granting or denying an exemption, unless the board of review determines there are substantial and compelling reasons why there should be a deviation from the policy and federal guidelines and these are communicated in writing to the applicant.

Maybe instead of nit picking on the length of the Peaine Township meetings you should commend Peaine Township on the great accomplishment of the defeat of township consolidation which saved Beaver Island from disaster.

General Supervisor McNamara called to order a regular meeting of the St. James Township Board at 5:00pm on August 1, 2018.

Approval of Minutes McNamara made an addition of the Planning Commission under committee reports.

Moved by Gillespie, supported by Powers to approve the following minutes as presented:

Motion Carried- Unanimous

Finance Report McNamara noted the check for the resurfacing of the Tennis and Pickle Ball courts is being held until an issue about a crack that was not repaired, is addressed. Moved by Powers, supported by McNamara to approve the following as presented:

 The Monthly Finance Report  Payment of Bills

McNamara obtained a quote for a trailer for the skid steer currently co-owned by both Townships and the Township Airport. The total cost of the trailer is $4000.00. Moved by McNamara, supported by McDonough to share total cost of trailer with the two other governmental entities, Peaine Township and the Township Airport. Motion carried- Unanimous

McNamara shared that the Auditor would come to review the audit during a special meeting at the end of this month. He will work with Gillespie to make all proper journal entries to finalize the year ending March 31, 2018. He will be paid hourly to perform additional accounting journal entries.
The board decided on 12:00 noon, on Wednesday August 29th, for the special meeting. McNamara will confirm with the auditor on the date, and then post for the meeting.

Correspondence/Updates/Committee Reports

Public Works Committee Report McNamara presented an updated timeline on the JA Woollam Foundation marina proposal. The committee decided to hold a community input session about the Harbor Plan on August 14th , 2018 at 4:00pm at the St. James Township Hall. The Harbor plan will become an addendum to the current Recreation Plan. Supervisor McNamara and Deputy Supervisor Cull will host the session.

McNamara presented a resolution adopting the Township position on the JA Woollam foundation Beaver Island Marina Purchase Proposal (attached).

Moved by Gillespie, and supported by Martin to adopt the resolution. Motion carried, resolution adopted- Unanimous

Clerks Update Gillespie reported that she performed the required preliminary testing and they are they ready for the election. Setup at the St James Hall for the election will be at noon on August 6th.

Treasurer’s Update The Municipal dock receipts are recorded in the finance report presented earlier.

Potential Firewood Ordinance McNamara stated she does not have any new information on this potential ordinance. She will present at the next meeting.

Little Traverse Nature Conservancy McNamara reported that she is waiting to receive more information back from LTNC. She will present that information at the next meeting.

Use of the Township Hall McNamara presented a draft policy on the use of the township owned property. The board will review and discuss at the next board meeting.

Other Action Items

Telecommunications Research Group McNamara presented a draft of the possibility of a Telecommunication Advisory Committee, which included both structure and guidelines. The board will have time to review and discuss at the next meeting.

Planning Commission
McNamara stated she would like to direct them to begin to work on the zoning ordinace to reflect the adopted Master plan. McNamara would also like to direct them to work on policies and procedures to deal with the abandoned cars on the island. There was a consensus of the board for her to direct chairman Tidmore on these two items.

Supervisor’s Report McNamara reported on Invasive Species Treatment, Tennis/Pickle Ball Courts, Sewer Annual Report, the Water Trail opening.

Public Comment The Hogarths asked about the public use of Clifton Avenue to get to their easement. Ed Wojan presented the board with the history of public use and ownership of the township owned Clifton Avenue.

Bobbi Welke stated the Historical Society Committee met and decided to give half of the Lighthouse tour donation proceeds to the township. She stated they hope the township will agree to let them open up the lighthouse for tours next year as well. They plan on giving half of next years proceeds to the township.

Elaine West asked for a status report from the planning commission on the blight ordinance

Kevin Boyle gave an update on the communications tower.

I am not sure what your dislikes with Peaine Township are but there is nothing I would change, I think the board members are doing a great job!

Not many people are willing to do such a thankless job, the only time they hear from people like you are when they are unhappy and I am yet to understand what you are unhappy about other than you would like long drawn out meetings to get the same thing accomplished. The same people that are unhappy are usually not the ones at the meetings asking questions or the ones willing to do any of the work to make changes, guessing YOU are one of THOSE people.

Plus Peaine township is the one place I can do the BEAVER BUMP!!!!!
